Terms of Use (EULA)

Introduction

Welcome to PredatorCast ("we," "our," or "the App"). This End User License Agreement ("EULA" or "Terms") is a legal agreement between you ("User" or "you") and BoringAppDevs for the use of the PredatorCast mobile application. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Agreement to Terms

By accessing or using PredatorCast, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the App, including free users and subscribers.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms within the App and on our website. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

2. License Grant

Subject to your compliance with these Terms, BoringAppDevs grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use PredatorCast on your personal iOS device for your personal, non-commercial purposes.

2.1 License Restrictions

You agree NOT to:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any illegal or unauthorized purpose
• Use the App to harm, threaten, or harass others
• Attempt to gain unauthorized access to any portion of the App or related systems
• Upload or transmit viruses or any other malicious code

3. Subscription Plans and Pricing

PredatorCast offers a free version with advertisements and premium subscription options that remove ads and unlock additional features. The following subscription plans are available:

3.1 Subscription Options

• Monthly Subscription: $0.99 per month
• Yearly Subscription: $9.99 per year
• Lifetime Purchase: $49.99 one-time payment

3.2 Pricing and Availability

All prices are in U.S. Dollars (USD) unless otherwise stated. Prices may vary by country or region. We reserve the right to modify subscription prices at any time. Price changes will not affect existing subscriptions until renewal.

3.3 Premium Features

Premium subscriptions include:

• Ad-free experience
• Unlimited fishing trips
• Advanced statistics with pressure analysis
• Enhanced bite prediction features
• Detailed pressure trend analytics
• Priority customer support
• Additional features as they become available

4. Payment and Auto-Renewal

4.1 Payment Processing

All subscription purchases are processed through the Apple App Store. Payment will be charged to your Apple ID account at the confirmation of purchase. We do not have access to your payment information – all transactions are handled securely by Apple.

4.2 Auto-Renewal Terms

Monthly and yearly subscriptions automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price you initially paid.

4.3 Managing Subscriptions

You can manage your subscriptions and turn off auto-renewal through your Apple ID account settings:

• Open the Settings app on your iOS device
• Tap your name at the top
• Tap "Subscriptions"
• Select PredatorCast and manage your subscription preferences

4.4 Lifetime Purchase

The Lifetime Purchase option is a one-time payment that grants permanent access to premium features without recurring charges. This is a non-refundable purchase as detailed in Section 5.

5. Cancellation and Refund Policy

5.1 Cancellation

You may cancel your subscription at any time through your Apple ID account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. No partial refunds will be provided for unused portions of a subscription period.

5.2 Refund Policy

All subscription purchases and in-app purchases are subject to Apple's refund policies. We do not have the ability to process refunds directly. To request a refund, you must contact Apple Support:

• Visit reportaproblem.apple.com
• Sign in with your Apple ID
• Find PredatorCast in your purchase history
• Select "Report a Problem" and follow the instructions

5.3 Non-Refundable Purchases

Lifetime purchases are generally non-refundable except as required by applicable law or Apple's policies. Monthly and yearly subscriptions are non-refundable once payment is processed, though future renewals can be cancelled at any time.

5.4 Free Trial Period

If a free trial is offered, you must cancel before the trial period ends to avoid being charged. If you do not cancel before the end of the trial period, your payment method will be charged the subscription fee.

6. User Responsibilities

6.1 Account Security

You are responsible for maintaining the security of your device and Apple ID account. Any activity that occurs under your account is your responsibility.

6.2 Accurate Information

You agree to provide accurate, current, and complete information when using the App. While the App does not require account registration, any data you input (fishing locations, catch information, etc.) should be accurate to ensure proper functionality.

6.3 Lawful Use

You agree to use the App in compliance with all applicable local, state, national, and international laws and regulations, including fishing laws and regulations in your area. You are solely responsible for ensuring your fishing activities comply with all applicable fishing licenses, permits, and regulations.

6.4 Age Requirements

You must be at least 13 years old to use PredatorCast. If you are under 18, you must have permission from a parent or legal guardian to use the App and make purchases.

7. Content Ownership and Intellectual Property

7.1 App Ownership

PredatorCast and all associated intellectual property rights are owned by BoringAppDevs. This includes but is not limited to the App's code, design, graphics, logos, features, and functionality. These Terms do not grant you any ownership rights to the App or its content.

7.2 User-Generated Content

You retain ownership of all content you create or upload through the App, including photos, fishing trip data, and notes. However, you grant us a limited license to store and process this content solely for the purpose of providing App functionality. As stated in our Privacy Policy, your data is stored locally on your device and we do not access or use your personal fishing data.

7.3 Trademarks

The PredatorCast name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of BoringAppDevs. You may not use these trademarks without our prior written permission.

8. Third-Party Services

The App integrates with third-party services including but not limited to:

• Weather and Pressure Services: For weather data, atmospheric pressure, and forecasts
• Google AdMob: For displaying advertisements to free users
• Apple App Store: For payment processing and subscription management

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• The bite predictions, pressure analysis, or weather data will be accurate
• Any errors in the App will be corrected
• The App will be compatible with all devices or operating system versions

Important Note: Bite predictions and fishing forecasts are provided for informational and entertainment purposes only. Actual fishing results depend on numerous factors beyond our control. We do not guarantee specific fishing outcomes based on App predictions.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BORINGAPPDEVS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of your data
• Any interruption or cessation of the App
• Any bugs, viruses, or similar harmful components
• Any errors or omissions in content or data
• Any fishing-related activities, decisions, or outcomes based on App data

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

11. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• At our sole discretion for operational or legal reasons

Upon termination, your right to use the App will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.

You may terminate your use of the App at any time by uninstalling it from your device and cancelling any active subscriptions.
