Terms of Use (EULA)

Introduction

Welcome to UnderPressure ("we," "our," or "the App"). This End User License Agreement ("EULA" or "Terms") is a legal agreement between you ("User" or "you") and BoringAppDevs for the use of the UnderPressure mobile application. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Important Medical Disclaimer

UnderPressure is a personal health logging tool. It is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment recommendations.

• The app is intended to help you log and track personal blood pressure readings over time
• Data displayed in the app (trends, classifications, history) is for informational purposes only
• Do not use the app to make medical decisions or to replace professional medical care
• Always consult a qualified healthcare professional for medical advice regarding your blood pressure or any health condition
• In a medical emergency, contact emergency services immediately — do not rely on this app

By using this App, you acknowledge and agree to this disclaimer.

2. Agreement to Terms

By accessing or using UnderPressure, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the App.

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms within the App and on our website. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms.

3. License Grant

Subject to your compliance with these Terms, BoringAppDevs grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use UnderPressure on your personal iOS device for your personal, non-commercial purposes.

3.1 License Restrictions

You agree NOT to:

• Copy, modify, distribute, sell, or lease any part of the App
• Reverse engineer, decompile, or attempt to extract the source code of the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any illegal or unauthorized purpose
• Use the App to harm, threaten, or harass others
• Attempt to gain unauthorized access to any portion of the App or related systems
• Upload or transmit viruses or any other malicious code

4. User Responsibilities

4.1 Accuracy of Data

You are responsible for the accuracy of data you enter into the App, including blood pressure readings, medication information, and contact details. The App cannot verify the accuracy of user-entered data.

4.2 Medication Information

The App allows you to log medication names, dosages, and schedules for reminder purposes only. The App does not verify medication information, check for drug interactions, or provide pharmaceutical advice. Always follow your healthcare provider's instructions regarding medications.

4.3 Account Security

You are responsible for maintaining the security of your device. Any activity that occurs on your device is your responsibility.

4.4 Lawful Use

You agree to use the App in compliance with all applicable local, national, and international laws and regulations.

4.5 Age Requirements

You must be at least 13 years old to use UnderPressure. If you are under 18, you must have permission from a parent or legal guardian to use the App.

5. Apple Health (HealthKit) Integration

UnderPressure can optionally read and write blood pressure data to Apple Health (HealthKit). By enabling this integration, you acknowledge:

• The App will read existing blood pressure readings from HealthKit and write new readings to HealthKit
• HealthKit data usage is governed by Apple's HealthKit guidelines and Apple's Privacy Policy
• We do not use HealthKit data for advertising or data mining
• You can disable HealthKit access at any time through your device's Health settings

6. Content Ownership and Intellectual Property

6.1 App Ownership

UnderPressure and all associated intellectual property rights are owned by BoringAppDevs. This includes but is not limited to the App's code, design, graphics, logos, features, and functionality. These Terms do not grant you any ownership rights to the App or its content.

6.2 User-Generated Content

You retain ownership of all health data you create or enter through the App, including BP readings, medication records, notes, and contact information. As stated in our Privacy Policy, your data is stored locally on your device and we do not access or use your personal health data.

6.3 Trademarks

The UnderPressure name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of BoringAppDevs. You may not use these trademarks without our prior written permission.

7. Third-Party Services

The App integrates with third-party services including but not limited to:

• Apple HealthKit: For reading and writing blood pressure data to Apple Health (optional)
• Apple App Store: For app distribution

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, accuracy, or practices of third-party services.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any errors in the App will be corrected
• The App will be compatible with all devices or operating system versions
• Blood pressure classifications or trend data will be medically accurate

Important: Blood pressure classifications and trend information displayed in the App are for general informational purposes only and are not a substitute for professional medical evaluation.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BORINGAPPDEVS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the App
• Any unauthorized access to or use of your data
• Any interruption or cessation of the App
• Any bugs, viruses, or similar harmful components
• Any errors or omissions in content or data
• Any health-related decisions or outcomes based on App data
• Any missed medication doses, missed checkups, or delayed medical care

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

10. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for any reason, including but not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• At our sole discretion for operational or legal reasons

You may terminate your use of the App at any time by uninstalling it from your device.

11. Updates and Modifications

We may periodically update the App to add new features, fix bugs, or improve performance. We reserve the right to modify or discontinue any features of the App at any time without notice.

We may also modify these Terms from time to time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after such modifications constitutes acceptance of the updated Terms.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the App shall be resolved through binding arbitration in accordance with applicable arbitration rules, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights.

13. Apple-Specific Terms

As UnderPressure is distributed through the Apple App Store, the following additional terms apply:

• These Terms are between you and BoringAppDevs, not Apple
• Apple has no obligation to provide support or maintenance for the App
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) in accordance with its policies
• Apple is not responsible for addressing any claims by you or third parties relating to the App
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you

14. Severability and Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BoringAppDevs regarding the use of UnderPressure and supersede all prior agreements and understandings, whether written or oral.
